In compliance with the provisions of Law 34/2002 of July 11, on Services of the Information Society and Electronic Commerce (LSSICE), these provisions regulate the use of the service of the Website https://kaleidoscope.es/ (hereinafter “Website”) that KALEIDOSCOPE makes available to Internet users.

Access to the Website is free except regarding the cost of the connection through the telecommunications network provided by the access provider contracted by the users. Certain services are exclusive to our clients and their access is restricted. The services provided by KALEIDOSCOPE generally have the price (VAT not included) indicated in the corresponding service proposal and are in no case offered or provided through the portal service.

In those cases and sections where our Website offers e-commerce services subject to contract or economic consideration, the General Terms of Contract must be accepted as specified.

The use of the Website grants the status of Website user (hereinafter, User) and implies acceptance of all the conditions included in this Legal Notice. The provision of the Website service is limited to the time when the User is connected to the Website or to any of the services provided through it. Therefore, the User must read this Legal Notice carefully each time they intend to use the Website, as it and its usage conditions contained in this Legal Notice may be modified.

Some services of the Website accessible to Internet users or exclusive to KALEIDOSCOPE clients may be subject to particular conditions, regulations, and instructions that, in their case, replace, complete and/or modify this Legal Notice and must be accepted by the User before starting the provision of the corresponding services.

All elements that make up the Website, including but not limited to texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound contents, as well as its structure, graphic design, source codes, logos, brands, and other distinctive signs appearing on it, are the property of KALEIDOSCOPE or its collaborators and are protected by the corresponding intellectual and industrial property rights.

The owner of the Website (KALEIDOSCOPE) expressly prohibits “framing” or the use by the User or third parties of any other mechanisms that alter the original design, configuration, or content of our Website.

The use of the contents must respect their particular licensing. Thus, their use, reproduction, distribution, public communication, transformation, or any other similar or analogous activity is totally prohibited unless there is prior and express authorization from the owner of the Website, KALEIDOSCOPE.

Only the total or partial reproduction of the texts and contents provided by the Website is authorized, provided that all of the following conditions are met:

The Website aims to facilitate the general public’s knowledge of the activities that this organization carries out and the products and services it provides, for the development of its activity.

The use of any functionalities of the Website implies the express and full acceptance of the conditions set forth herein, without prejudice to those particular conditions that may apply to specific services offered through the Website.

KALEIDOSCOPE is not responsible for decisions made based on the information provided on the Website or for data and damages caused to the User or third parties due to actions based solely on the information obtained on the Website.

The information is subject to periodic changes without prior notice regarding its content for expansion, improvement, correction, or updating of the contents of the Website.

5.2.- OF THE QUALITY OF THE WEBSITE SERVICE

Access to the Website does not imply an obligation on the part of KALEIDOSCOPE to control the absence of viruses, worms, or any other harmful computer elements. It is the User’s responsibility, in any case, to have the appropriate tools for detecting and disinfecting harmful computer programs.

KALEIDOSCOPE is not responsible for any damage caused to Users’ or third parties’ computer equipment during the provision of the Website service, nor for the malfunctioning of the Web browser or the use of outdated versions of it.

5.3.- OF THE AVAILABILITY OF THE SERVICE

Access to the Website requires services and supplies from third parties, including transportation through telecommunications networks whose availability, quality, continuity, and functioning do not correspond to KALEIDOSCOPE. Consequently, the services provided through the Website may be suspended, canceled, or become inaccessible, prior to or simultaneously with the provision of the Website service.

KALEIDOSCOPE is not responsible for any damage caused to the User resulting from failures or disconnections in telecommunications networks that cause the suspension, cancellation, or interruption of the Website service during its provision or prior to it.

5.4.- OF CONTENTS AND SERVICES LINKED THROUGH THE PORTAL

The access service to the Website includes technical linking devices, directories, and even search instruments that allow the User to access other pages and portals on the Internet (hereinafter, “Linked Sites”). In these cases, KALEIDOSCOPE acts as a service provider in accordance with Article 17 of Law 34/2002, of July 12, on Information Society Services and Electronic Commerce (LSSICE) and will only be responsible for the content and services provided on the Linked Sites to the extent that it has effective knowledge of their illegality and has not deactivated the link with due diligence.

If the User believes that there is a Linked Site with illegal or inappropriate content, they may inform KALEIDOSCOPE in accordance with the procedure and effects established in clause 7, without this communication implying an obligation to remove the corresponding link in any case.

In no case should the existence of Linked Sites be presumed to imply the existence of agreements with the persons responsible or holders of such sites, nor the recommendation, promotion, or identification of KALEIDOSCOPE with the statements, content, or services provided.

KALEIDOSCOPE does not know the content and services of the Linked Sites and therefore is not responsible for damages caused by the illegality, quality, lack of updates, unavailability, errors, and uselessness of the content and/or services of the Linked Sites, nor for any other damage that is not directly attributable to KALEIDOSCOPE.

For cases where personal data is collected, processed, or stored, this will be done in accordance with the Privacy Policy published on the Website, which can be consulted in the footer of the Website.

The Website uses cookies in accordance with our Cookie Policy, which can be consulted in the footer of the Website.

8.- COMMUNICATION OF ILLEGAL OR INAPPROPRIATE ACTIVITIES

If the User or any other Internet user becomes aware that the Linked Sites refer to pages whose content or services are illegal, harmful, defamatory, violent, or contrary to morals, they may contact KALEIDOSCOPE providing the following details:

The receipt by KALEIDOSCOPE of the communication provided for in this clause shall not imply, as provided for in the LSSI, effective knowledge of the activities and/or contents indicated by the notifier.

9.- MODIFICATION OF THE LEGAL NOTICE

In order to improve the services of the Website, KALEIDOSCOPE reserves the right to make, at any time and without prior notice, modifications and updates to the information contained in the Website, its configuration and design, and this legal notice, as well as any other specific conditions. Therefore, the User must read the Legal Notice on each occasion they access the Website.

10.- JURISDICTION

KALEIDOSCOPE reserves the right to take civil or criminal action it deems necessary for the improper use of the Website and its Content, or for the non-compliance with these conditions of the Legal Notice.

For any issues that arise regarding the interpretation, application, and compliance of this Legal Notice, as well as claims that may arise from its use, all parties involved will submit to ordinary jurisdiction, submitting to the Judges and Courts that correspond according to law.

The applicable law in case of dispute or conflict regarding the interpretation of the terms that make up this Legal Notice, as well as any issues related to the services of this Website, will be governed by the current regulations applicable in Spanish territory.
